Time Limits on Medical Negligence Claims
It is important to know that most medical negligence claims have a time limit on them – which is 3 years from the date of the occurrence. However, if you are seeking this on behalf of a child, you can make the claim at any point up until their 18th birthday, at which point you then must make it within 3 years (so before they are 21).
There are some exceptions to the above rules, for example, if the person affected by the medical negligence lacks mental capacity. However, regardless of the timeline and situation, it is always advisable to seek legal advice as quickly as possible so that you can get the best possible outcome.
Claim Process and Court Proceedings
If you do decide to work with me, the general claim process would start with me contacting those responsible for the negligence and ask them to formally accept responsibility.
However, although it is preferable to negotiate claims outside of court, some opponents will not accept blame or agree to the compensation amount, which means we will need start court proceedings. Even in this situation, many claims are settled before their court date.
